Meeting Minutes

Janet Weidner, Chair, opened the meeting at 4:35 p.m.

Meeting Minutes
Board reviewed minutes from March 23, 2009 and approved as amended.

New Business:

Applications:
       Allen Healy presented a Form A Application Subdivision. Map 11, Parcel 29-4  dividing off a non-buildable parcel of 1.01 acres leaving a 3.02 acre Lot. The parcel has frontage and access on Quansoo Road and could be made into an Affordable Homesite Lot with a Special Permit from the ZBA. The Planning Board did suggest a common driveway from the access road to limit the number of driveways into the two contiguous lots.
        The Board voted unanimously to approve the Form A Application.

        Wind Bylaw Discussion:
        Mr. Yeomans came before the board to suggest some changes in general language within the WECS proposed bylaw. Within these suggestions, Mr. Yeomans discussed that his language changes were directed toward creating clearer document, one that would be a more respectful bylaw for neighbors. One specific wording change Mr. Yeomans suggested was, “a windmill may not be placed closer to a residence on an abutting property than it is to the principal residence.”  The word “equidistance” was used to describe the setback. The board thanked Mr. Yeomans for his time, consideration and input on this bylaw.
        
Penicaud Curb Cut:
Margaret Penicaud, residence at 205 State Road, came before the board for an informal discussion pertaining to a possible new curb cut on her property that overlooks Menemsha Pond. Her property has very deep trough topography and already has an access driveway. This would be a second access off of State Road to this property to access a guest house. The Planning Board did not appear to favor the proposed second curb cut as it would not meet the 1000 ft. separation between curb cuts mandated in Zoning Bylaws and Roadside Disctrict, but suggested a site review of the ZBA to request a special permit.
















Proposed Wind Bylaw Discussion:
The discussion of the proposed bylaw centered on the depth of the information and the fact that this was a lengthy document that may not be clear enough for town voters to understand all of the technical data within. Some of the members questioned bringing this document to the town when it appeared they were unable to support this bylaw as written. After this discussion, it was suggested that the Planning Board withdraw this proposed bylaw due to lack of community feedback and incomplete knowledge of wind turbines as a fast changing technology. A motion was made to withdraw the proposed bylaw, seconded and unanimously approved to withdraw the proposed bylaw on Wind Energy Conservation Systems. Ms. Jones suggested that the town consider migratory bird patterns when siting wind turbines.

Master Plan Survey Data Summary:
The board was presented with the summary of the Data from the Master Plan Survey that will be presented to the Town at ATM. The board was pleased with the presentation.

                Updates:

                DAS: Distributed Antenna System:
The board had some discussion on the joint DAS Committee meeting held at the Chilmark Community Center April 6th. The whip antenna and the diameter of the poles had been a sticking point during the meeting. ATC had originally presented the plan using existing poles, or stump poles to place whip antennas. This was not what was presented to the joint committee. One single tower idea placed centrally on Peaked Hill was discussed.
 
North Tabor Farm: Mr. Walton informed the Board that he had spoken with Bill Wilcox of the MVC, who had been the acting Dukes County Agricultural Agent and he agreed to be reappointed to the North Tabor Farm Committee as the Agricultural Agent.
